The city of Delray Beach has banned the hiring of workers who are smokers. That cannot be constitutional. It might be constitutional under the South African constitution.
If Delray Beach can do this, they can decide not to hire people for any reason they deem appropriate.
The city commission claims that smokers can cost a company or government agency an average of $12,000 a year in health and disability-related costs. They don’t know that and even if were true, using that standard, they can’t hire women either. Women get pregnant and need contraceptives therefore they cost too much. How much do drunks cost? Why don’t they refuse to hire people who are overweight?
There will be no end if government anywhere in this country is allowed to pull these stunts.
