Another Lawsuit Against Arizona & Sheriff Arpaio Stripped of Authority to Enforce Immigration Laws

Update: 12/21: Now the DHS is replacing 90 of Sheriff Joe Arpaio’s staff with paper pushers from DHS to make it appear to the public that the government is actually working on illegal immigration. Update 12/20: According to the Dayton Tribune, ICE gives lie to AG Holder’s phony case against Sheriff Joe Arpaio. 

…Back in March of 2009 the DOJ informed sheriff Arpaio that a probe was underway to investigate what the DOJ claimed were “alleged patterns or practices of discriminatory police practices and unconstitutional searches and seizures.” This is where things get sticky for Eric Holder and the Obama Administration.

Six months prior to this investigation the Immigration and Customs Enforcement agency (ICE) had already conducted its own investigation of sheriff Arpaio’s office and not only gave it a clean bill of health, they actually gave a raving review. The report said things like “The OI and DRO supervisors consider the conduct and performance of the MCSO … officers to be professional and meeting the requirement of the MOA.” And that they considered the working relationship between the feds and the sheriff’s office to be “excellent” and that cases brought by the sheriff’s office to be “high quality.”

The DOJ then got caught with its pants down when more government documents were uncovered under the Freedom of Information Act that suggests politics may be at the root of the investigation. Sheriff Arpaio’s lawyers found a March 11, 09 e-mail, that was sent just after the Justice Department investigation was announced, from an Immigration and Customs Enforcement agency employee to John P. Torres who was at the time the acting assistant secretary of ICE. The email said: “Did you see this?” attaching a news report on the investigation. “Yes,” Torres responded a few minutes later. “Interesting politics at play.”…

Original Story: The open borders crowd has been clamoring for Sheriff Arpaio’s enforcement of immigration law to end. They want illegals to come into the U.S. without any restrictions for free healthcare, education, food stamps, welfare.

They will rob us of our freedoms if we allow this to continue. We cannot afford this.

Eric Holder claims that Sheriff Arpaio, in trying to enforce immigration law, is biased against Latinos. Arizona will be sued yet again based on these false claims.

Janet Napolitano followed up by stripping Sheriff Arpaio’s department of the authority to enforce immigration laws.

…Assistant Attorney General Thomas Perez, head of the department’s Civil Rights Division, claims the DOJ’s three-year civil investigation found that the sheriff and his deputies engaged in unconstitutional conduct and violations of federal law that jeopardized his “commitment to fair and effective” law enforcement.

In addition to blasting Sheriff Arpaio, the Justice Department is expected to file a lawsuit in the U.S. District Court in Arizona asking a federal judge to order changes in the sheriff’s office.

Critics of Holder and Obama believe the Arpaio case is designed to coincide with the U.S. Supreme Court’s hearing on Arizona’s immigration law (SB1070), and as strategy to bring back the president’s Hispanic base…

…Meanwhile, Homeland Security Department Secretary Janet Napolitano wasted no time piling on Arpaio. She stripped his department of its authority to enforce immigration laws and regulations.

“Accordingly, and effective immediately, DHS is terminating (the Maricopa County Sheriff’s Office’s) 287(g) jail model agreement and is restricting the Maricopa County Sheriff’s Office access to the Secure Communities program,” stated Napolitano…Read here: Washington Examiner
