DOJ Can Shut Down Bank Accounts of Businesses Based on Political Ideology

In October 2014, thirty members of Congress sent a letter to the Department of Justice demanding an immediate investigation into the DOJ’s Operation Choke Point which is being used by the government to attack enterprises the Obama administration opposes. Gun businesses have been at the top of the list.

These businesses are vulnerable and serve as easy marks. The government has done a good job convincing people guns are responsible for crimes.

There is at least one smoking gun that possibly proves the DOJ operation is being used to destroy some businesses including gun manufacturers.

What is happening is this: Because of pressure from the DOJ, banks and payment processors are denying or terminating loans and are restricting access to payment systems for law-abiding and legitimate businesses such as gun manufacturers to avoid unwarranted investigations and legal actions by the DOJ and federal financial regulators. It’s all being done under Operation Choke Point.

There is evidence from a 60-page government document that Fast & Furious was being used to destroy the Second Amendment. Investigative reporter and firebrand Sharyl Attkisson acquired the documents from a much-delayed FOIA request.

The owner of Hawkins Guns LLC lost his bank. He spoke to people at the bank, including the manager and it’s all on tape.

The bank officials said they don’t deal with businesses that deal with guns.

This is the Second Amendment we are talking about.

A bank teller told the owner, Mike Scheutz, “We have to answer to the examiners. Whoever they are.”

The U.S. Consumer Coalition posted audio of those recordings.

The Heritage Credit Union regional manager told Schuetz:

“Examiners from NCUA [the National Credit Union Administration] came in and looked at our accounts … looked at our books. Here’s some accounts that we feel that we’re going to regulate you on … and kinda put the screws to us as far as what we could and couldn’t do. The regulatory and compliance issues that we said earlier are true. We never used to have to do that stuff.”

It is a smoking gun.

The Department of Justice’s Operation Choke Point gives unlimited power to the executive branch to just shut down bank accounts of businesses at will! That means a business can’t run if the government has a hankering to shut them down. They don’t even need to provide due process.

It is what tinpot dictatorships do.

Senator Ted Cruz grilled the Acting Associate Attorney General, Stuart Delery, a smart but weasly pencil pusher Tuesday.

It is clearly an anti-Capitalist initiative of the United States Department of Justice and it was first announced in 2013.

The government is investigating banks in the United States and the business they do with payment processors, payday lenders, and other companies believed to be at higher risk for fraud, money laundering, and terrorist financing but they go way beyond investigating criminals.

The executive branch – and its DOJ – get to decide who the offenders will be outside any oversight by Congress.

It is being used to choke businesses they don’t like and banks they want to menace.

It poses an existential threat to due process as well as the Second Amendment.

The program cuts off companies’ access to banking services without having to show that the targeted companies are violating the law.

The government doesn’t have to show or prove a thing!!!

Innocent businesses are being made to suffer and perhaps fold. Businesses cannot survive without a bank to do business with.

Some of the merchant categories that the FDIC had listed until July 2014 as being associated with high-risk activity include, but are not limited to (until the FDIC revised the original policy in July 2014) these listed below, and of course they include firearms – what a great way to destroy the Second Amendment!

Who will get to decide what is a home-based charity or racist material or a travel club and so on? What will happen to banks who loan money to gun manufacturers? There are serious implications for our First Amendment and it goes well beyond gun companies if this is allowed to stand.

Governor Huckabee described Operation Choke Point on his Fox News Show with businesses other than guns shops. The government wants to decide what is a sin and what isn’t, who can survive and who can’t.
