Senate Judiciary Chairman Chuck Grassley, R-Iowa, and eight others on the committee sent a letter to DHS Secretary Jeh Johnson last week demanding he clarify a leaked DHS document which shows intent on the part of the administration to violate what are now two court orders to refrain from legalizing millions here illegally. It’s unconstitutional.
The government has been discussing an Employment Authorization Document (EAD) regulatory change. EAD is the statutory term for work permits.
A leaked internal DHS memo reveals that Obama is planning to completely ignore a federal court injunction that suspended part of his deferral-based amnesty last year. It would have legalized about 6 million illegal immigrants, the hill reports. It gets worse. The administration has a plan to legalize all people here illegally in violation of immigration law.
The leaked memo states that a benefit of the proposed action would be to “authorize the presence of certain individuals who are not here lawfully and address the needs of some of the intended deferred action population.”
As the administration was ostensibly waiting for a decision, they were planning to violate the court’s decision.
The plan includes four options and it will even include visa overstayers in the legalization scheme. We won’t even know who these people are. it will negate the employment-based visa system voted in by Congress.
The options include:
Providing EADs to “all individuals living in the United States”, including illegal aliens, visa-overstayers, and H-1B guest-workers, while option 4 provides EADs only to those on certain unexpired non-immigrant visas. Giving EADs to any of the covered individuals, however, is in direct violation of Congress’s Immigration & Nationality Act and works to dramatically subvert our carefully wrought visa system.
The first plan includes anyone here physically. It would include DAPA, Expanded DAPA, unrestricted EADs to temporary non-immigrant visas, and 6 million more illegal immigrants not covered by any Obama amnesty programs.
It will include everyone here illegally and it’s probably more than 11 million people though that is not a small number.
DHS claimed in the memo that it can unilaterally “de-couple the 1986 IRCA work authorization statutes from the main body of US visa law.”
“The administration now claims unprecedented discretionary power to permit anyone inside our borders to work”, the hill reported.
The memo also brags that it could cover the greatest number of individuals.
They have concluded in this memo titled, “Regulations Retreat”, that the labor market has been tested and these foreign workers will not “adversely affect US workers.”
Barack Obama is going to issue another illegal executive order and the letter questions whether the administration will guaranteed that they will refrain from such an order.
The letter states that the administration would be enacting de facto legislation.
The Justice Department has announced that they will appeal to the Supreme Court on this case.
There are only eight signatories and it’s highly unlikely the administration will deign to respond.
Why did only eight Senators sign it?
In addition to Sen. Grassley, seven other Republicans signed it: Sens. David Vitter of Louisiana, Orrin Hatch of Utah, John Cornyn of Texas, Jeff Sessions of Alabama, Mike Lee of Utah, David Perdue of Georgia, Thom Tillis of North Carolina, and Ted Cruz of Texas.
