Lawsuit Attempted to Implement Shariah Inheritance Laws in the US

Something to watch for — there are those who hope to see the implementation of some aspects of Shariah law in areas of the country that have large populations of Muslims. Shariah is not the religion itself, it’s the political system tied to Islam.

Minnesota has come more and more under the influence of a large population of Muslim immigrants. US law applies but that was recently contested in state court.

The state Court of Appeals affirmed a Hennepin County District Court decision that a widow, Nariman Sirag Elsayed Khalil, will be the one to benefit from a $183,000 settlement over her husband’s death.

The husband’s brother argued in court that Shariah should apply which would mean the widow would only get 25%, 16.7% would go to his mother’s estate and the remainder to the husband’s siblings. Males would receive ‘twice the share of the female.’”

The claimant didn’t bother to provide a transcript of lower-court proceedings so the judges could check his claims which helped end the case.

What happens the next time when the ACLU is funding the case?

The ruling found: “The district court found that ‘there is no credible evidence to prove Mr. Ombabi’s mother, brother, or sisters experienced a pecuniary loss, or more importantly what that pecuniary loss is, because of Mr. Ombabi’s passing.’

What happens in the case of a husband supporting a mother? Does Shariah apply then?

Shariah violates our beliefs in due process and equal protection under the law. Under Shariah, a woman’s testimony is only half a man’s.

American courts must apply American law and can’t open the law up to myriad laws adhered to by other cultures. Giving more to men than women is not acceptable under US law, yet Islamic law declares that is the law.

Shariah activists would see inheritance or finance lawsuits as the camel’s nose under the tent to implementing Shariah in the US, but it is a danger to our way of life.

Some Europeans have allowed Shariah courts. It must not happen here. Freedom of religion is a very important American value but Shariah is part of the political system and it cannot co-exist with the US Constitution. It runs counter to our values.

Fighting Shariah is really no different than fighting the ideology of Communism.
