Both Marco Rubio, a Republican Senator from Florida, and Jonathan Turley, a Democratic constitutional lawyer and Georgetown University law professor, believe we are in dangerous times because Mr. Obama is acting like an Emperor and changing our rule of law.
Mr. Obama is not only ignoring Congress, he is ignoring the Supreme Court of the United States. If he doesn’t like a SCOTUS ruling, he sues or finds a way around their ruling. He never abides by the spirit of a law with which he disagrees.
The damage to our tripartite system of government could be irreversible.
Mr. Obama’s recent direct violation of the law is only one more step of many that he has taken to violate our constitution and his oath as president. It’s almost as if he is looking for ways to trample the powers of congress and grow the power of the presidency.
Marco Rubio addressed it on Fox news Tuesday.
“The law is very clear. He must give congressional notification 30 days before any prisoner in Guantanamo is released,” Rubio told Fox News’ Gretchen Carlson on Tuesday. “He failed to do that.”
“Apparently the only person he told was [Senate Majority Leader] Harry Reid,” Rubio said. “He didn’t even tell the chairwoman of the Intelligence Committee, a Democrat, Dianne Feinstein.”
Rubio said the lack of notification was part of a “pattern of behavior by this White House.”
“He believes somehow that he’s become a monarch or an emperor that can basically ignore the law and do whatever he wants,” Rubio said. “And there’s a real, growing frustration — even among Democrats — at this sort of behavior.”

A JAG attorney was on Fox News this morning explaining that Bergdahl will never be courtmartialed in all likelihood because the National Security Advisor and the Commander in Chief have said he has served honorably and they both applauded his service. Mr. Obama said Tuesday that he has no interest in courtmartialing Sgt. Bergdahl. Military officials will not go against the Commander in Chief who has illicitly co-opted the decision.
In addition, Bergdahl can claim he never intended to leave permanently and avoid the charge of desertion.
On Hannity last night, Jonathan Turley said, The president has chosen to not comply with federal law. ” Professor Turley agrees with many of the president’s initiatives but not the means he is using to go about achieving them.
We are at a tipping point and face a constitutional crisis.
Professor Turley said “Unfortunately, our system is changing without even a debate or even a discussion” and what is “emerging is an imperial presidency” in which “a president can act unilaterally.”
We have had a stable system for 200 years because of limited and share powers.”He told congress he’d go it alone, in our system, you can’t go it alone,” Turley said.
“…the biggest problem we have, the system itself, if we have a dominant branch, simply begins to shut down in terms of the safeguards. People don’t seem to understand that the separation of powers is not about the power of these branches, it’s there to protect individual liberty, it’s there to protect us against the concentration of power, that’s what’s occurring here,” Turley warned.
“Barack Obama is the president Richard Nixon always hoped to be,” Turley said.
