Harry Reid will NOT send the amnesty bill (Senate bill s744) passed by the Senate to the House because he is threatened with a “blue slip.” A blue slip is a resolution that requires the return of  any bill that violates the “origination clause.” The origination clause requires all revenue raising bills originate in the House.

In other words, it is blatantly UNCONSTITUTIONAL!

It wouldn’t be the first time. The Senate corrupted a bill meant to help veterans, gutted it, transformed it into Obamacare, and passed it into law without the House approval. That’s one that got by and that is being contested in the courts. That will be a less blatant violation because they took an actual bill  and completely transformed it so the House wouldn’t get to vote on it. They would have put the Kabosh on it.

The Senate immigration bill is unconstitutional because it raises taxes and violates the requirement that all revenue bills must originate in the House, according to House Ways and Means Committee Chairman Dave Camp.

According to Newsmax, Camp said there are “five instances in which the Senate bill violates the Origination Clause of the Constitution, pointing first to the mandate that some fines and fees go into the Comprehensive Immigration Reform Trust Fund to pay for implementation of the legislation and border security.”

“In addition, he said, the parts of the measure preventing non-citizens from receiving premium tax credits included in Obamacare would have a ‘revenue effect,’  and that not requiring agricultural employers ‘to pay or withhold taxes from paychecks would reduce federal revenues.'”

“Finally, Camp argued, requiring employers to pay a fee into the STEM Education and Training Account and mandating the collection of a surcharge on visas also violates the clause.”

Rep. Stockman had promised to seek to automatically kill the Senate amnesty bill through the use of a “blue slip” resolution and now Harry Reid won’t even send the bill to the House. He knows it would make them look ridiculous because it is unconstitutional.

“Even Harry Reid now admits the Senate’s amnesty bill is unconstitutional and cannot become law. Any bill that raises revenue must start in the House” Stockman said. “By creating their own amnesty taxes Senate Democrats broke the rules. Senate Democrats were so hell-bent on ramming through a gift to radical political activists they didn’t bother to check if it was even legal.”

“They got caught trying to sneak an illegal bill past the Constitution’s borders,” said Stockman.

 The amnesty bill, Section 2102, requires the payment of certain taxes and forgives the payment of other taxes as a condition of receiving amnesty and other benefits, which is clearly a constitutional privilege of the House. Boehner has already said he will NOT take up the Senate bill. The House will come up with their own bill which will develop immigration reform in sections, with border security first. This will enable the leaders to give each attempt a chance to be tested and evaluated so the people can actually see what works!
