In what is most likely nothing more than a political exercise, forty-six senators are willing to sign on to an amendment to the Constitution that would repeal the free speech clause in the Bill of Rights.
Using the excuse of limiting the Citizens’ United decision, 46 Senate Democrats have proposed amending the Constitution’s free speech protections by giving Congress the power to alter the First Amendment.
The Democratic talking points are that the amendment would regulate campaign funds, which is by the way in violation of a decision by the Supreme Court which allowed corporations the right to donate anonymously under the First Amendment.
Every single individual, however, would be affected.
Elected Democrats want to give Congress the power to muzzle U.S. citizens and to ban what they want to ban, according to Cruz.
“This should trouble everyone,” Cruz said.
The proposal seeks to prohibit corporations from contributing unlimited amounts of money to election campaigns, but Cruz sees the move as a backdoor attempt by Democrats to eviscerate the First Amendment because it could ban publishers, movie producers and political groups from being able to engage in political free speech.
Cruz called it “the single most radical and most dangerous proposal that has been introduced in the 113th Congress.” It would repeal the First Amendment he warned.
This amendment gives Congress the right to regulate corporations such as book publishers. He quoted the ACLU’s stance on the issue, which is that the proposal would, “severely limit the First Amendment and lead directly to government censorship of political speech.”
“Citizens United was a movie, this whole thing was started because a movie maker dared make a movie critical of Hillary Clinton,” said Cruz. “You know it was their constitutional right to do so just like it’s Michael Moore’s constitutional right to make movies that those on the left celebrate.”
According to Cruz, the amendment would restrict the free speech rights of not-for-profit corporations, a designation which would include a whole swath of different political groups, including those on the left like the NAACP and the Sierra Club.
“These are the Fahrenheit 451 Democrats,” said Cruz, a reference to the dystopian novel by Ray Bradbury in which firefighters burn books to suppress freedom of thought.
The Democrats seem to like the idea of limiting free speech. They still have the amendments to the Free Flow of Information Act floating around the Senate. They would effectively end alternative media’s ability to exist because they define what a journalist is and it doesn’t include bloggers. There is the “Multi-Market Study of Critical Information Needs” (CIN) still hanging like the Sword of Damocles. That seeks to control what the media puts out and launch an affirmative action style control over TV and print media.
It’s a bad trend and it shouldn’t even be open for discussion.
