If you are an Arapaho, you can kill an American Bald Eagle for a religious sacrifice.
Our national bird, which is “Threatened” and is still on the “Protected” list is going to be a sitting duck, I mean a sitting eagle.
Of course, if you are a Gibson Guitar maker, that same agency – Fish & Wildlife (EPA) – will send armed agents to raid your factory looking for fretboards made with legal Indian wood (and then they will confiscate them and investigate you at great expense).
Now, if you are not entitled by the Obama administration & his US Fish & Wildlife to murder our national bird for a religious sacrificial ceremony, you could end up in jail with a criminal record.
That is what happened to Toby Lee Dalton, 21, of Eastpoint and Willie Pelt, 19, of Port St. Lucie in Florida for killing a bald eagle.
The United States Attorney for the Northern District of Florida charged both subjects with violating the United States Bald and Golden Eagle Protection Act (EPA), 16 USC 668 (a). Both men pled guilty in U.S. District Court on 04/25/01. Under the EPA the men could have received a maximum penalty of one year in Federal Prison, and up to a $100,000 fine. The Bald Eagle is listed as a threatened species under the Endangered Species Act.
Dalton was sentenced to 9 months in Federal Prison. Pelt was sentenced to 18 months probation, 50 hours of Community service at the St. Vincent National Wildlife Refuge, and forfeiture of the .22 Magnum Rifle used to kill the eagle.
Then there is the case of the Mississippi man, Joshua Lee Garrison of Mississippi, who pleaded guilty to killing a bald eagle, in violation of the Bald and Golden Eagle Protection Act. Garrison was sentenced to six months of house arrest, a $2500 fine, two years of probation, and revocation of his hunting and fishing privileges for two years.
There are other such cases.
On the other hand, if your religion requires you to not support contraceptives/abortifacients and abortion (you know, killing babies), tough luck, the Obama administration doesn’t care.
They are only killing two bald eagles for now, but I doubt this will be the end of it. The government can do anything and their idea of social justice is warped!
…The U.S. Fish and Wildlife Service has taken the unusual step of issuing a permit allowing an American Indian tribe to kill two bald eagles for religious purposes.
The agency’s decision comes after the Northern Arapaho Tribe in Wyoming filed a federal lawsuit last year contending the refusal to issue such permits violates tribal members’ religious freedom. Although thousands of American Indians apply for eagle feathers and carcasses from a federal repository, permits allowing the killing of bald eagles are exceedingly rare, according to both tribal and legal experts on the matter.
“I’ve not heard of a take permit for a bald eagle,” Steve Moore, lawyer with the Native American Rights Fund, or NARF, in Boulder, Colo., said Tuesday. “I see it and NARF would see it as a legitimate expression of sovereignty by the tribe, and respect for that sovereignty by the Fish and Wildlife Service.”
Federal law prohibits the killing of bald eagles, the national bird, in almost all cases. The government keeps eagle feathers and body parts in a federal repository and tribal members can apply for them for use in religious ceremonies…Read here: CBS News
