The Supreme Court on Thursday ruled against a federal freeze on evictions, dealing a blow to the Biden administration’s unconstitutional eviction moratorium.
The CDC created a law.
The CDC, which ordered the moratorium because of the shutdowns prompted by COVID-19, extended its ban past July 31 because of the spread of the highly contagious delta variant after pressure from progressive politicians.
That was after the Supreme Court clearly wrote in their last decision that the moratorium could not be extended.
In a 6-3 ruling with the three leftist justices dissenting, the court lifted the stay on a federal judge’s order which found the Centers for Disease Control and Prevention eviction moratorium unlawful.
The opinion is unsigned.
“It would be one thing if Congress had specifically authorized the action that the CDC has taken. But that has not happened,” the court wrote.
“It is indisputable that the public has a strong interest in combating the spread of the COVID–19 Delta variant. But our system does not permit agencies to act unlawfully even in pursuit of desirable ends,” the justices added.

The other great issue is the Congress trying to delegate it’s power, so that the politicians don’t have to go on record when there is a hard political choice. The way Congress does it’s business needs serious reform. This situation is also a problem at the State and Local levels as we have seen incredible Tyranny by Governors and Mayors. We need must stricter laws to quickly remove and jail Politicians who overstep their authority.

This is akin to eminent domain by an agency that has no authority to make laws or dictate policy regarding property rights. Those effected should bring a joint action suit against the government for allowing the CDC to usurp the rights of property owners.
For this to have been allowed at all, with the damage done, shows the awful state of America. This was a big loss, for a medical agency to be allowed to rule on property rights.
The CDC has been a key participant in the virus scam, yet our corrupt officials allowed them to also usurp property rights.
I’m not sure even Congress has the authority to pass such a law. It would come pretty close to the “Takings Clause”. It is nearly impossible to make every affected person to be made whole in any legislation.
