Daniel Penny is still on trial for trying to protect people on a train. A newly released video shows witnesses on the train defending Daniel Penny to police.

“The guy in the tan (Penny) did take him down really respectfully… he didn’t choke him.” She said Penny held him with only enough strength to constrain him and suggested Neely was on drugs.

A witness said Jordan Neely was “off the charts.”

The media keeps calling it a chokehold to make it sound worse and get him convicted. The man is a hero.

A daily subway rider told the jury she’s seen many incidents on the train before, but on May 1, 2023 on board the F train, she said, “There was a moment where I thought I was truly going to die.”

She explained a screaming Neely entered the subway car in soiled clothing.

“He said, ‘I don’t care if I die. I don’t care if you die. Lock me up for life.’ Very, very, very aggressive threats,” the witness said.

She testified she didn’t see Neely make any physical contact with anyone. She also didn’t see any weapons on Neely, but she said, “But I truly felt that he was most likely armed.”

With nowhere to go because the train was in motion, she said she felt a sense of relief when Penny restrained Neely.

Neely’s father stood up in the gallery and as he left said, “She’s a f***ing liar.”

The family is looking to sue.

Cellphone video taken by a high schooler was also played. That teen took the stand visibly nervous, soft-spoken, and crying at one point. In a 911 call played in court, she told the operator Neely was “trying to attack everybody.”

Penny has pleaded not guilty to second-degree manslaughter and criminally negligent homicide.

Prosecutors argue Penny’s intentions were good but that he took things too far, using excessive force in placing Neely in a chokehold for nearly six minutes. The defense says Penny was trying to protect other subway riders.

Penny is a hero. Neely was well-known to police as a problem with multiple arrests.

Yea, Just heard testimony from some guy who helped penny restrain the deceased. He said he tried to tell Penny to let GO? Seems Penny is a Freak. Freak is Gonna Pay. H`ll get to go to Prison; and Perhaps, someone will put him in a Choke Hold.

Do some research. That witness has been caught lying to the DA multiple times. Which version of his stories do you believe? He’s even reported this week that he’s STILL afraid to tell the truth (despite immunity) because of the “cries of racism” and the lynch mob outside the courthouse. That witness has a lot of problems.

Penny’s crime is that he defended himself and others. That’s a capital offense in NYC, a place that won’t even allow you to buy pepper spray. Never go to NYC. Not safe.

The witness lied because he is afraid of BLM. I believe this witness; because I have lots of street fighting experience -from my youth- and I recognize PENNY as a Spaz. He Looks like a Spaz too! He should have “let go” when urged by the other guy helping him. No … He Freaked Out and Killed the Guy! This is going to hurt penny , as it puts him up for greater charges. Choke holds are Dangerous! Choke holds are Lethal Force.

You can defend yourselves; but you have to know the Law. Neely did not Physically Attack Anyone. He ran his Mouth! When people JUST run their mouth there is no Justification for Lethal Force. YOU call the Police, or You shout Him down, then if it gets Physical you have More Force Justification. You just do not want to play Captain America; because if you accidentially Kill someone youll be held just as responsible as any Cop.. Pepper spray used on a Subway Train would Suffocate the Entire Train Car;So, it would not be wise to use that in close proximity. Tasers work Better. Some people have bad asthma and can die if pepper spray is discharged in such close proximity. Thats why NY banned it I am sure.

You’re incorrect. The witness told Penny he wasn’t holding Neely tight enough! He admitted to seeing space between Penny’s arm and Neely’s neck, and that Neely was still resisting BOTH of them. The version of the story you are quoting was his second version, after the immunity agreement. The first version he told the police was also a lie, as video evidence had already refuted his first version. Now, we’re on the THIRD version of his story, that Penny wasn’t gripping tight enough. Like I said, this witness is very problematic AND he is admitting the crowd outside is making him afraid to tell the truth, and that he didn’t tell Penny to let go. Cries of racism are intimidating the witness per HIS OWN admission. This trial is a mess. Welcome to NYC justice.

Neely is Dead so the Grip was Lethal. This is Evidence. I really do not care; seriously, but I can do the math. In court, this is bad and penny is going to be sentenced for accidental death/manslaughter.

The Crowd is Trouble. The Witness Vacillation will be Problematic. However, the burden of Justifying lethal force was not met and this will go against Penny. Besides, if something is not done the crowd will go nuts. This is Bad, And, this is why you should think before you act.

The police, constrained by terrible woke council nd a faililng court system let ths predator loose to terrorise, and the hero is blamed.
One would think this happened on Janujary 6th and he was wearing a MAGA Hat. Until government at all levels is cleaned up from swamp waste, people will not be safe.
