Anthony Fauci Takes the Fifth, Illegally – Update 4

Here is a new one from the Florida Senator.

Dr. Fauci has pleaded the Fifth Amendment in an explosive Senate inquiry. This follows the release of shocking COVID-era diary entries by Doctor Fauci during the pandemic. The diary contains 1,100 pages and of detailed contradictions between what Fauci was claiming in public vs what he was doing in private.

New York Times reporter Shawn McCreesh summed up the contents of the diary in this memorable way:

Dr. Fauci’s diary reads like a black comedy of manners in which a 79-year-old social-climbing scientist becomes the face of the government’s response to a pandemic and then the toast of the town — the toast of this town. As the death toll rises, so too does the doctor’s status and self-regard. He falls in with a fast crowd and becomes consumed by his own image.

Senators Josh Hawley, Rand Paul, and Bernie Moreno put Fauci on notice when Fauci took the Fifth on every question.  Hawley said,“Let’s just get one thing straight. You don’t have any rights under the Fifth Amendment because you’ve been pardoned.”

The Fifth is for people who might incriminate themselves, but Fauci can’t be incriminated or prosecuted.

Biden handed Fauci a preemptive, full pardon covering potential federal offenses from 2014 through January 2025. Once you accept a presidential pardon, the legal jeopardy for those federal crimes is gone. Supreme Court precedent (going back to Brown v. Walker) is clear: if there’s no realistic risk of prosecution for the covered offenses, the privilege against self-incrimination doesn’t apply to them.

So Fauci’s lawyers are shifting, stalling, and having him take the Fifth anyway. They know the ground under that privilege is shaky now. You don’t hide behind the Fifth when the pardon already wiped the federal slate clean for the relevant period. Hawley called it out in real time. Fauci and his team can keep repeating the magic words, but the pardon they accepted changed the rules.

Senator Moreno didn’t hold back. This was brutal.

Senator Hawley let loose.

Democrats are reading poetry to Fauci. It’s not Dante’s Inferno, but it should be.

Dr. Fauci’s lawyer wouldn’t stop screaming, so he was ejected. It figures Tony would have a crazy lawyer.

This Is Why the Lawyer Went Bonkers

Sen. Paul informs Anthony Fauci that he’s BREAKING THE LAW by REFUSING to answer questions in this hearing. Fauci could go to prison for one year.

PAUL: “In the red folder on your table is a copy of Section 192 of Title II of the US Code… That section makes it a CRIME for a witness appearing under subpoena to refuse to answer any questions pertinent to the question under inquiry. Do you have that in front of you?”

FAUCI: “pleads the fifth”

PAUL: “Let the record show that the witness has refused to answer whether there’s a folder in front of him based on his Fifth Amendment right”

That is when Fauci threw his lawyer at him.

Dr. Anthony Fauci will not answer any questions at today’s hearing. They really need to break that pardon.

He was shaking as he made his statement at the beginning of the Senate hearing.

Fauci wouldn’t consider therapeutics.
