The Department of Homeland Security stated that New York released nearly 7,000 undocumented immigrants with active ICE (Immigration and Customs Enforcement) detainers rather than transferring them into federal custody.
Federal reports say these individuals had records or pending charges involving assault, weapons offenses, sexual predatory offenses, and homicides.
Federal officials attribute these releases to state and local “sanctuary” rules that limit local cooperation with federal immigration agents.
Governor Hochul’s office rejected the federal figures and claims as false. Of course she would say that, but even if some aren’t criminals, they came illegally and broke our laws. Additionally, New York no longer treats misdemeanors as criminal offenses for illegal aliens.
State representatives said that New York regularly turns convicted violent offenders over to federal authorities after they finish serving their state prison sentences. It isn’t true. It clearly doesn’t always happen, as Attorney General Letitia James writes on the agency’s page.
State officials maintain that local law enforcement should focus on state criminal laws rather than civil immigration enforcement. Democrats now say coming into the country illegally is always a civil offense. It isn’t the case federally. Under 8 U.S.C. § 1325, entering or attempting to enter the United States without authorization, outside an official port of entry, or by hiding facts is a federal crime.
In my opinion, as soon as Democrats are back in power, they will re-open the borders as they have suggested. We can’t survive Democrats. Hochul is up for re-election; vote Bruce Blakeman, who did an amazing job in Nassau County, New York.
