SCOTUS Might Soon End Congress’s Independent Agency Scam

The Supreme Court is actively evaluating the constitutionality of independent federal agencies. The conservative majority is poised to reconsider or overturn a 90-year-old precedent (Humphrey’s Executor v. United States). For 90 years, it has likely been unconstitutional.

It looks like Congress’s creation of rogue agencies independent of Executive authority is about to end.

Justices Kavanaugh and Alito obliterated the arguments in favor of the “independent commission” scam, and the left is panicking. This is a win for President Trump and the people.

Congress cannot call cabinet offices “independent” and basically wipe out presidential power.

Kavanaugh stated the obvious. “Independent agencies aren’t accountable to the people. They’re not elected. Yet they’re exercising massive power over liberty and billion-dollar industries.”

The opposing argument is that independent agencies serve the public good and are removed from presidential power. However, they do the opposite. They allow bureaucrats to take power from the President, who was elected by the people.
