
An Austin federal magistrate judge has ordered Elon Musk to testify under oath in two proposed class-action lawsuits. This is over his 2024 $1 million-a-day voter giveaway.
A magistrate judge isn’t a real judge in my opinion. A magistrate is a political appointee with limited responsibilities. They assist higher-level judges in minor or civil cases.
The lawsuits accuse Musk and America PAC of misleading voters in swing states. They said he claimed winners would be randomly selected from people who signed a petition supporting the U.S. Constitution. Reuters reported that U.S. Magistrate Judge Susan Hightower also recommended that a fraud claim proceed in one case. A related breach-of-contract was dismissed. U.S. District Obama Judge Robert Pitman will review that recommendation.
The dispute turns on whether voters were misled into providing personal identifying information. America PAC has previously argued that recipients were selected not only as random lottery winners, but also they could be good spokespeople.
Hightower said it was an open question whether Musk acted recklessly when saying he would “randomly” pay someone, Reuters reported. She quoted America PAC director Christopher Young, who said as he testified in a February 2026 deposition that he was “surprised” by what Musk said. Wow, what news.
This alleged fraud lawsuit was brought by two Arizona women.
Plaintiffs Joy Harvick and Jacqueline McAferty accused Musk and America PAC of misleading voters across seven swing states by having them sign his petition, the outlet reported. They said the 19 winners were chosen because, as a Musk lawyer put it, they could be good spokespeople for America PAC.
Joy Harvick appears to be the person who sued Elon Musk in 2024 for diversity breach of contract. Jacqueline McAferty might be a retired lawyer in Mesa, Arizona.
This comes after Elon Musk said he would sue Ro Khanna for accusing him of killing children, and after he became a trillionaire.
