San Francisco State Senator Scott Wiener is running for the U.S. House, and he is in the lead. He has pushed for some very radical laws. Take the Family Law Gender Identity bill, for instance.
The “Family Law Gender Identity” bill, AB 957, passed California’s State Assembly on May 3rd. Radical state Senator Scott Wiener (D-SF) tacked on an amendment on June 6, 2023, that mandates parents affirm a minor’s “gender identity as part of the health, safety, and welfare of the child.”
If a parent doesn’t accept a child changing gender, the parent would be guilty of child abuse. They could take the child away. California courts would have the authority under Section 3011 of California’s Family Code to remove a child from his or her parents’ home if parents disapprove of LGBTQ+ ideology.
By changing the definition of what constitutes the “health, safety, and welfare of [a] child,” schools, churches, hospitals, and other organizations interacting with children would be required to affirm “gender transitions” in minors by default. If they don’t, they risk charges of child abuse.
It did not pass, but other controversial bills did.
Wiener introduced Senate Bill 145 on January 18, 2019. The bill proposed to remove the requirement to place someone convicted of non-forcible oral or anal sex with a minor over the age of 14 (provided the convicted is less than 10 years older) on the sex offender registry, instead leaving this to the judge’s discretion, as was the case for vaginal sex. He argued that existing law was discriminatory towards LGBTQ couples where the partners were just above and below the age of legal consent. The bill was signed into law by Gavin Newsom in September 2020.
In 2021, Wiener authored SB 107, a “trans refuge bill” to protect transgender children seeking gender-affirming care in California and their families from civil and criminal punishment under other states’ laws. The law would restrict the enforcement of out-of-state laws and policies that penalize gender-affirming care in subpoenas, arrest warrants, and parental custody cases. SB 107 became law in 2022.
