Trump Court Win: Infrastructure Grant Cannot Be Based on Race or Ethnicity

A federal judge in Washington, D.C., ruled that the race-based funding allocation criteria in the Digital Equity Act are unconstitutional. However, the court ruled the provision is severable, meaning the Trump administration must reinstate the $2.75 billion competitive grant program but without utilizing racial or ethnic classifications.

The money wasn’t the problem. The DEI racism is the problem.

U.S. District Judge John Bates heavily cited the Supreme Court’s decision invalidating affirmative action in higher education admissions in agreeing with President Trump, who has called the program “racist.”

“At this stage, what matters is that the Digital Equity Act empowers the government to consider race when allocating federal money,” Bates wrote in his 35-page opinion.

The Democrat program under Joe Biden was part of the inflation-causing $1.2 trillion infrastructure program aimed at providing “Internet for All.”

The grant was to provide the funds only to racial minorities or other covered populations, which definitely didn’t include white people.

The media is painting the case as a loss since the President wanted to dismantle it.

However, he wanted to dismantle the DEI component, and that has been okayed. Congress passed the act, so President Trump had to know that only Congress can dismantle it.

President Trump can now offer the grants to people regardless of race or ethnicity.
