A federal judge issued a temporary restraining order early today. Judge Kelly mandated that the White House restore “hard pass” press credentials for CNN, MS Now, and Politico for at least 14 days.
District of Columbia Judge Timothy Kelly found that the plaintiff has shown a likelihood of success at least on their Fifth Amendment procedural due process claim. There was no due process. The judge also noted that the national security claim was not tied to the plaintiff’s claims that the networks are dishonest. The focus was on their dishonesty. Nothing in the record predated the suit to suggest the revocation of the plaintiffs’ passes was motivated by national security complaints.
