A U.S. appeals court has upheld a lower court’s injunction that prevents the Trump administration from implementing a new U.S. Postal Service (USPS) rule that would tighten mail-in voting requirements ahead of the November 2026 midterm elections.
It prohibits the U.S. Postal Service from implementing Trump’s directive. The Postal Service has said it would not deliver ballots from states that did not pre-clear their envelope design with the federal government and submit a list of voters to an online portal, which has yet to be activated.
On September 10, 2026, a three-judge panel of the 1st U.S. Circuit Court of Appeals — all appointed by President Joe Biden — declined to lift the preliminary injunction issued by U.S. District Judge Indira Talwani.

Election officials warn that it’s impossible to comply with those terms, especially with the first mail ballots already being sent out in Alabama, North Carolina and Wisconsin.
The decision comes as the U.S. Supreme Court is already considering the same case. With mail-in ballots going to everyone, there is a good chance the election will be corrupted. In New York, Democrats always won the absentee ballots handily, and many looked very questionable.
The Lawsuit to Keep Feds Away from Polling Places
Additionally, Denver city government and a Latino open-borders group are suing to keep armed agents from serving warrants at polling places. That does sound like we have people here illegally voting in Denver.
The lawsuit argues that Homeland Security Secretary Markwayne Mullin and David Venturella, the acting head of Immigration and Customs Enforcement, are violating federal laws protecting free and fair elections by allowing federal agents to enforce immigration laws at polling sites, the New York Times reported.
Democrats fight hard for this sort of thing.
