Obama Judge Indira Talwani violated the Supreme Court’s order banning nationwide blocks by district judges. However, she hasn’t yet officially ruled on the most recent emergency order allowing parts of the mail-in balloting executive order to go through.
The Supreme Court lost their enforcement mechanism back in the early 1800s, but either they or perhaps Congress could impeach her. Congress can legally take her district away. Certainly, her order is illegal and the President should not follow it. The USPS should go ahead.
If they won’t even impeach Judge Boasberg, they probably won’t impeach her. Without accountability, rogue judges will keep ignoring the Supreme Court and they will escalate. It appears she is escalating.
She even accused the government of “feigning complete compliance” as she refuses to abide by the Supreme Court rulings banning nationwide injunctions by district judges. District judges’ rulings can ony affect their districts.
This is unprecedented and unconstitutional, but this challenge to SCOTUS’s authority and delaying tactic might be worth it to her. There is never any accountability.
