In Scotland, the criminal misgendering law includes a definition. Misgendering occurs when a person “communicates material a reasonable person would consider insulting and likely to result in hatred being stirred up.” So, sending a joke to a friend misgendering somebody could result in prosecution. It depends on what “reasonable” means, which could mean anything. The US doesn’t have an equivalent law yet, but Democrats have discussed it.
