A judge in Colorado handed Donald Trump a terrible loss. He faces another trial while he’s running for President. Colorado District Judge Sarah Wallace refused to dismiss a lawsuit to block former President Donald Trump from appearing on the 2024 ballot in Colorado over claims he was involved in the “insurrection.”
He’s going to trial in this case on October 30th.
Democrat Governor Jared Polis appointed the judge.
The suit claims that Trump’s name on the ballot would violate the 14th Amendment, which prohibits anyone from holding office engaged in insurrection or rebellion against the United States. In the 24-page ruling, Wallace wrote that the issue of whether Colorado Secretary of State Jenna Griswold has the power to remove Trump’s name from the ballot is a pivotal issue and one best reserved for trial.
President Trump and the GOP have tried to get this ridiculous case dismissed.
In her ruling, Wallace wrote, “If the party, without any oversight, can choose its preferred candidate, then it could theoretically nominate anyone regardless of their age, citizenship, residency; such an interpretation is absurd. The constitution and its requirements for eligibility are not suggestions left to the political parties to determine at their sole discretion,โ she said.
So, the judge didn’t deal with the issue of the 14th Amendment. Instead, she claimed they couldn’t make a decision unless they went to trial.
Democrats are terrorizing the leading Republican candidate. This ruling and the trial threaten democracy and set a dangerous precedent. The court system is weaponized to ban a candidate the opposing party doesn’t like. There was no insurrection. That was always absurd.
Donald Trump is polling at 59.1%, more than 46 points ahead of his nearest GOP competitor, Governor Ron DeSantis.
