This is another fakestream news story. NY Magazine wrote that Trump will walk into a dangerous constitutional situation and will be subject to the Emoluments Clause that Elizabeth Warren has been blathering about. The belief on the left is that unless he divests of all his business holdings, they can go right to Impeachment.
There is disagreement over whether the president is exempt from certain federal conflict-of-interest laws that apply to other public servants but he is not exempt from the Emoluments Clause, the left believes.
The left believes that the Emoluments Clause covers the president and it covers just about any situation in which a public official profits in any way from a foreign state or such a state’s “agents and instrumentalities.”
The Emoluments Clause is found in Article I, Section 9 of the Constitution, and it reads, “No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.”
The left likes the Constitution when they can use it to batter the right.
They quote the “bipartisan” paper drawn up in favor of Trump’s situation being threatening. It was bipartisan because a lawyer under Bush was involved, however, the Bush’s hate Trump, wouldn’t even vote for him.
Last Friday, the Brookings Institute released a very helpful 23-page paper that serves as a rather forceful rebuttal to Tillman’s interpretation. The authors argue that a common-sense reading of the Constitution and the relevant legal theory and history all lead to the conclusion that Trump is, in fact, subject to the Emoluments Clause, and could therefore be walking into an unusual sort of constitutional danger zone. The paper was written by a bipartisan trio of legal experts who have been active in this discussion: Norman L. Eisen, a Brookings fellow, the chair of Citizens for Responsibility and Ethics, and a former chief White House ethics lawyer under Obama; Richard Painter, a vice-chair at CREW and former chief White House lawyer under George W. Bush; and Laurence Tribe, a constitutional-law professor at Harvard.
Fresh off the Electoral College fake news, they’re going right to Impeachment. They will make hay out of Russian hacking but Impeachment is the next fake story.
The left also has a petition out to impeach him. Someone needs to tell them he’s not in office. They would rather not make America great again. They like the misery of the past eight years.
