Some State Leaders Will Refuse to Enforce Unconstitutional Gun Laws

Update: 1/18: koco.com is reporting that Oklahoma City sheriffs will not enforce federal gun laws.

Linn County Sheriff Tim Mueller joins several other public officials across the nation who have decided to square off with the White House even before it outlines what its plans are for expanded measures.

Mueller sent a letter to Vice President Joe Biden this week saying he won’t enforce any federal regulation “offending the constitutional rights of my citizens.” He won’t permit federal officers to come to his county to enforce such laws either, he said.

 

Original Story: 1/17: President Obama pulled back on many of his administration’s threats to the Second Amendment prior to yesterday’s press conference. He did, however, vow to push Congress to ban certain guns and impose strict gun laws.

One of the actions he will put through via executive fiat will give more freedom to medical professionals to question patients about whether they own guns and then report them to law enforcement if they have concerns. Action 17 states: Release a letter to health-care providers clarifying that no federal law prohibits them from reporting threats of violence to law-enforcement authorities.

Putting aside the whole questionable idea of a doctor turning in a patient, consider the possible lawsuits. It makes doctors more vulnerable.

In fact, the psychologist who was seeing James Holmes, the Aurora Theater killer, is being sued by one victim’s wife on the grounds that she should have placed Holmes on a 72-hour watch. This type of lawsuit will have more weight thanks to Obama’s action. The University has been advised that eleven similar lawsuits are to follow.

President Obama’s action appears to unfairly put too much of the onus on doctors and other medical professionals.

President Obama announced twenty-three executive actions in all during the conference but most don’t have teeth. The actions might, however, signal the erosion of our Second Amendment.

New York’s slippery slope is far steeper than the federal one thanks to Governor Cuomo’s rushed gun law put through the day prior to Obama’s conference.

If gun owners are tracked, questioned, and taxed into giving up their guns, won’t that have the same effect as eliminating the Second Amendment? Nothing like punishing legal gun owners and doing nothing about illegal gun owners.

At the same time we have the media on a witch hunt to slander legal gun owners and destroy the reputation of the non-partisan Second Amendment defenders – the NRA.

State officials, including some of the nation’s sheriffs, in Mississippi, Oregon, and Texas warned the Obama Administration that they would not enforce laws that violate the Second Amendment.

In Oregon, Linn County Sheriff Tim Mueller wrote a letter to Biden Monday saying his department will not enforce any new gun laws it considers unconstitutional.

He wrote that politicians are “attempting to exploit the deaths of innocent victims” by supporting laws that would harm law-abiding Americans. The sheriff said he took an oath to support the Constitution, and laws preventing citizens from owning certain semi-automatic firearms and ammunition magazines would violate their rights. [FoxNews]

Some pro-gun advocates see yesterday’s conference as a shot across the bow of the Second Amendment. They believe gun confiscation in the future is a legitimate fear. Indeed, Governor Cuomo of New York mentioned gun confiscation as a possibility – he let the cat out of the bag.

During his press conference, President Obama never mentioned Hollywood and their violent movies which are often geared towards youth. It was noticeably absent.

The media is solidly against gun rights and has launched a full-scale attack on gun owners and gun rights. I googled NRA today and came up with pages and pages of anti-gun sites, including several from the Brady campaign and Think Progress.

President Obama said that banning some guns is worthwhile even if it saves one life. Following that logic, shall we ban cars since so many die in car accidents?

President Obama plans to pressure Congress into passing a ban on 120 “assault” guns among other measures. It does not have a chance of passing, but some on the pro-gun side are taking a proactive stance.

Republicans in Washington County, Utah are preparing legislation to exempt Utah from federal gun laws and to levy a $5000 fine on any federal agents who attempt to seize guns from any Utah citizen. This resolution would only allow Utah sheriffs to seize guns.

The Supremacy Clause of the Constitution might prohibit this law. [standard.net]

Texas Attorney General Greg Abbott is putting out ads inviting lawful gun owners in New Yorker to move to Texas and enjoy their Second Amendment rights. Andrew Cuomo’s gun law, SAFE, has neutered the Second Amendment in the State of New York.

From a Facebook ad from AG Abbott:

“Here in Texas, you will have the liberty and the opportunity to achieve your dreams. On top of that, we have no income tax, yet still manage to have a multi-billion dollar budget surplus.

“We have right to work laws and a reasonable regulatory environment. Texas has created more than 275,000 jobs in the last year alone! And we’ll fight like hell to protect your rights.

“You’ll also get to keep more of what you earn and use some of that extra money to buy more ammo. [Politico]

Greg Abbott’s campaign popup ads have slogans such as, “Is Gov. Cuomo looking to take your guns?” Another says, “Wanted: Law abiding New York gun owners looking for lower taxes and greater opportunity.”

[Abbott has been a target of the left for accepting campaign funds from capitalists.]

Rand Paul joined the NRA in asking for armed guards at schools. A number of liberal legislators are outraged by this suggestion, saying that this is not what we want for our schools. We do not want this kind of environment for our children. I agree but unfortunately  that is the world we live in.

If we are not going to deal with our violent culture, if we are going to allow open borders, then we need to accept that all our children need more protection.

The correlation between harsh gun laws in states does not correlate with gun murder rates:

  • Vermont has liberal gun laws but they have negligible murders with firearms.
  • The District of Columbia, with their harsh gun laws, has the highest per capita murder rate in the nation. Seventy-one percent of their murders are with guns.
  • In Illinois, despite their suffocating gun laws, 83% of their murders are with firearms.
  • New York has some of the strictest gun laws in the nation but 57% of the murders are from firearms.
  • The overall statistics, however, do not seem to firmly support either side. Some states with strict laws have fewer firearm murders and visa versa, indicating that the problem isn’t guns, at least not solely. Violence has become part of our culture.
  • Utah has some of the more permissive gun laws in the country but they regulate the sale, possession, and use of firearms and ammunition. They protect public safety at the same time. Gun crimes can all be prosecuted as felonies.

Utah is one of the states that has the lowest murder rates committed with a firearm but they take gun crimes seriously. They might have found a formula for protecting both the Constitution and their residents. It is not about the gun, it is about prosecuting the criminal to the fullest extent of the law. New York has the most lenient prosecutions of gun crimes in the nation. They are the strictest in going after legal owners. Brilliant!
